with donald trump's campaign, adamantly denying an explosive report about him. the atlantic magazine, citing two sources claiming to have heard the 45th president say during private white house conversations that he wanted the kind of generals that hitler had. trump's former chief of staff, retired marine corps general john kelly confirms the report. kelly it also told the new york times that he has heard trump praised adolf hitler. trump is facing growing criticism for his extreme rhetoric against immigrants and political rivals, with some saying his language is reminiscent of dictators we pledge to you that we will root out the communists, marxists, fascists, and the radical left thugs that live like vermin within the confines of our country now a murderer, i believe this it's in their genes. and we got a lot of bad genes in our country right now. they're poisoning the blood of our country that's what they've done. they poisoned mental

institutions and prisons all over the world. they're ruining our country and it's true that destroying the blood of our country that's what they're doing. they're destroying our country. they don't like it. when i said that and i never read mein kampf. they said, oh, hitler said that in a much different way. >> joining us now is cnn military analyst retired lieutenant general mark hertling. he's a former us army commanding general for europe. and the seventh army general hertling, always good to talk to you we don't typically talk about a campaign politics, but how remarkable is the statement from general kelly retired four-star general secretary of homeland security, white house, chief of staff. how much stock do you put in his warning about donald trump? >> first off, jim, i'll say yeah, we don't talk about politics much. i don't like to talk about politics because i'm the military analyst, but i do know john kelly and i noticed him to be a man of

integrity and honor. we served together in combat in iraq in 2007 and eight he was in the west an area of iraq. i was in the northern area of iraq and we conducted some operations together. >> so the announcements yesterday and his audio recording for the new york times were somewhat striking it is interesting that he would wait until now to say these kinds of things. >> there had been indications that these kind of things went on over the past several years within the mr. trump's white house. but it was fascinating to me, some of the details that he gave. and by the way, listening to john, on those tapes, you could tell he was pained by telling some of these stores this is not something that a military man, someone who wears the cloth of the country for so many years, enjoys talking about they expect more of their leaders.

and it really paint him to answer the questions of the new york times reporter. so that's all part of the things we have to take an operation on this yeah and general kelly, i mean, he says to the you're times as you said, that trump falls into the general definition of a fascist and just recently and we can put this up on screen or about general milley, the former chairman of the joint chiefs, general mark milley, described trump as quote fascist to the core and the most dangerous person to the country. >> he said this to bob woodward for his book, war and general hertling. i just want to ask you this because when you have general kelly when you have a general milley, it i think you touched on this a little bit earlier, comments. it is not at all normal. it is not at all something that you typically see when you have generals i mean, as high ranking as you can get, making these kinds of statements about a president of the united states and somebody

who could become president i think doesn't that speak to the seriousness of this? >> well, it does. jim, but i'd also say, you know, i've watched the media over the last several months in different cable channels, different newspapers and there have been many civilians who have said, we need the generals that were in the administrations to come out and speak and i'll go back to what i said a minute ago the generals don't like to do this because they know it influences civilian military affairs. they don't like to tell people who to vote for. they like to apply the rule of law to their, to their military duties. and they expect to be he connected to leaders who do the same so these kinds of interviews not formal announcements, but the kind of interviews that break the story. and interestingly enough, when i, when i heard the description, as you just said, about john kelly talking about fastest, what what i

think the reporter did was read the definition and then john kelly said, yeah, that kind of fits that. that's about as adamant likely going to get. but it's still there's still a hesitation and speaking outwardly about that because that's what generals do. >> and general hertling, i apologize. i don't have a lot of time, but i did want to ask you about trump making these comments about the quote, enemy from within. despite the criticism that he's received from making these kinds of comments, he doubled down over the weekend. he has suggested that he might use the military or the national guard against quote, enemies from within i asked colonel cedric leighton about this last week if you are a general, you're over at the pentagon or you're a governor in charge of a national guard, a commandant charge of the national guard, and you get an order from a president trump telling you to send soldiers out to round up americans to go after democrats up on the hill.

what do you do well, legally, for the national guard, the president has to either a mobilize them officially and put them under federal law at that point, he can ask a governor to deploy their own national guard or suggest that the governor does it, but truthfully, the national guard, if it's not under federal command, still relies on the governor's order. >> the governor is the commander in chief of the guard the thing that was a little bit more problematic was when mr. trump talked about mobilizing, the active, even the active, duty military, i think he's going a statement that's a little woke contentious because active duty military are under the rule of posse comitatus. unless the insurrection act is called. if an insurrection act is called by the president and the guard and the military is deployed. there is no more posse comitatus. they can do what the president orders him

years. here we are 13 days before the election, and i'm talking to general hertling about potential president trump ordering the military to go after i'm, american citizens i know you speak on behalf of republican causes and candidates and so on. from time to does any of this give you pause? general kelly making these comments, general milley making these comments donald trump's own words jim, jim, i've had pause for years, right? >> and this is the latest example and the rhetoric is shocking, but also not surprising. and that's why i think the political impacts on this are going to be very limited. i go back eight years, about two weeks ago, there was a friday afternoon. i was in chapel hill, north carolina and this tape came out kahiau to call it access hollywood. and everything that we knew about politics said that race was over. and in fact, i said that on the record to the wall street journal the next morning i was in raleigh at a political event for richard burr, my former boss and i realized this race is not over and we're in that same situation right now,

voters have so made up their minds on donald trump. they have factored all of this in. this is the latest and it is shocking and terrible language. and i believe it but this is the latest donald trump outraged use your his voters aren't going to pay attention to it. and those undecided voters still want to hear from kamala harris tonight with anderson. what are you going to do as president? that's gonna be the decider in this election if she's able to make that case, not something donald trump has said or done. >> and why is that? why, why does this not damaged trump's? chances revelations that trump is has said that he wished he had hitler's generals and john kelly zhang, he's, he's, he meets the definition of a fascist. i mean, here we have mike pence should come as no surprise that i will not be endorsing donald trump this year. this goes on and on. mark esper, the former defense secretary general milley. trump is fascist to the core taken together, this does not resonate. >> if you look at that list is very, but trump hasn't been on this by certainly the

republican base. so let's compare it to joe biden right? joe biden had a bad debate. we all know it. and his democratic supporters were knifing him you know, off the record sometimes on the record, donald trump has loyal support. you had the senator from tennessee on earlier. he's behind them 100%. so he has that base of support and you have other voters who just, they factored this in because there have been so how many dealbreakers for donald trump that haven't broken the deal? >> and the trump campaign is sharply denying all of this. they're putting out statements from people like mark meadows and kash patel who were very much in the trump orbit we're not exactly getting somebody who is sort of independent on all i met mark meadows the night before he was sworn in as a member of congress. >> i wouldn't say that he has been festooned with honesty or dignity. and there's the story of him getting on his knees in front of john boehner and literally begging for forgiveness. so i can discount anything that martin meadows says, the trump loyalists are going to back donald trump. that's their job. but again, i go to those voters who are undecided at this point, they

know what they think about donald trump, and they're saying kamala harris, tell me who you who are and what you're going to do and doug, i mean, you also have i think your finger on the pulse of those wavering republicans, those centrist republicans moderate republicans, who may decide to vote against donald trump ultimately what does kamala harris need to say to those voters? >> should she be talking about what general kelly and general milley are saying or she's she be talking about more meat and potato, bread and butter issues. she should be talking about what their concerns are. >> and that's about the economy that's about prices. so i watched the debate with liz cheney the other day and harris didn't get into specifics on what voters are saying very loudly. this is what we need to hear from and if she continues that, she loses. >> and this is i mean, this is the statement on the reporting and the atlantic for mark meadows. i do want to read this just out of a sense of fairness here any suggestion that president trump disparaged this gan or refused to pay for her funeral expenses is absolutely false. that is the statement about the other piece of the atlantic reporting that trump at one point said in regards to

unions. if you read into project 2025, rampage 600 he talks about really basically busting unions, canceling over overtime pay as he boasts, i'm not taxing over time. he doesn't tax it in his you know concept of a plan because he would not allow it. he would not allow for overtime. so he is not pro-union. he would harm union workers we have to do more to do everything we can to educate them and harness the amazing number of union workers who get it harris/walz is the most pro-union ticket ever vice president has made abortion access a key part of her strategy. >> she already leaves leads on that issue. she does not lead in the polls for economic plans or immigration shouldn't policy. but abortion, it has reproductive rights has been an area where she is obviously leading in the polls what is your sense of how that the issue is resonating in pennsylvania right now, is it perhaps a factor that maybe the

polls aren't taking into account enough that the, perhaps the narratives that you hear in the news media aren't taking into account enough well, i have to tell you, i think there's an awful lot in the polls that is not being counted. i was just at jenkins town high school and a 17-year-old male student came up to me instead. i'm so glad that you are leaning in on the issue, roe dobbs and that you will promise to bring roe back and codify women's rights. >> he said like my gosh she should have those rights 17 year-olds are getting it. now. he's not able to vote until next year, but it tells me there's a tremendous number of men and women, young men, young women, who get this and are probably not reflected in the polls. what donald trump has done as a result of the dobbs decision has sent women and girls into second class that i have three daughters. are all in three granddaughters. >> we're not going to tolerate this vote will reflect that i'd asked you to take a look at bucks county.

fact of life he is a convicted felon so you know, sadly a punishment will fit that. we won't run that punishment for some time now. but i think much more important is what you just reported on generals really literally against what they would normally ever do in terms of talking about the leader of the free world because of their firsthand experience, they are almost making 911 calls to the electorate to say this is too dangerous. what donald trump is capable of and has said, and has done in the past, will only be worse. >> you know, he talked in his first and last and all girl address about the american carnage sadly, that was a foreshadowing of his presidency. and so i, i'm much more impressed by these patriots who were republicans who wanted nothing more than for donald trump to succeed, who were saying don't let him anywhere near the white house. >> he is a fascist to his core

killing his 2-year-old daughter more than 20 years ago. >> but his lawyers say the shaken baby syndrome diagnosis at the time was wrong and that new evidence proves at roberson's attorney, gretchen sween joins us now and gretchen, let's let's jump into this. there's this legal battle over how your client will testify before the house committee why is it so important that it'd be done in person? and not virtually clarify this important point, because i think the suggestion that robert was a no-show makes it sound like there was some change of heart and there are definitely wasn't the problem was that the understanding i had when i accepted this subpoena on his behalf was that he would be physically present at the capitol and indeed the next day i was had communications with the directors of the prison system who had no problem with this. >> and we're even just

guessing with me ways to make robert feel comfortable getting him street clothes he could wear. but i learn saturday night through media that apparently he was going to come via zoom which would have been completely unworkable because of multiple factors. the most prominent of which is that he has severe autism, which affects his ability to communicate he has a speech impairment. any experience with zoom from years of being in solitary confinement on death row? so i objected to this, but it wasn't to him testifying. it was to this switch to an alternative method that really wasn't going to work and accomplish the mission of assessing his credibility and his demeanor in person and this case is far from over in texas law requiring an execution be set and at least 90 days in advance walk us through. that.

doesn't sound like he's out of the woods in terms of facing execution that's absolutely right. so my anxiety has lowered somewhat. he's he's still alive. were still able to fight to be heard in court but at any moment after this temporary restraining order expires, which i believe is at the end of this month the local district attorney could go seek a new execution date and then as you've noted, the law requires we get at least 91 days notice but there's no other barrier. it's up to that local district attorney and she could do that. we genuinely hope that all of the attention brought to the multitude of concerning facts here and all the evidence that has never been considered by any court. might cause a pause button to

be pressed at that local level, but i don't know. i have not heard anything on that front. >> and the governor of texas, greg abbott, is apparently is arguing that the house committee subpoena that delayed roberts execution violated the state separation of powers clause. is that correct what's your response to that? it sounds as though the governor wants to see this execution go forward i'll note two things. >> one is the separation of powers argument was presented to the texas supreme court a court that consist of nine elected republicans the unanimous vote was nine to zero, that this was a valid subpoena. and that the temporary restraining order that allowed it to go into effect was also a valid exercise of the trial courts. judge and that there are questions of separation of power that need to be

reasonably briefed and adjudicated. so there's this there's a big picture issue, but there really wasn't any debate about the legitimacy of what these lawmakers harris did. you just had the effect of saying an execution because they're witness would have been unavailable permanently had the execution gone forward. there there is no affirmative law. i know of that says only a governor can stop an execution. in fact, courts can do that and we had tried to get a stay from multiple courts. it's just we had not prevailed he did have this power governor abbott, that is unique to him to grant a 30 day reprieve that's a separate way to stop an execution but he didn't exercise it and, he doesn't lose that power because of what the lawmakers did. he chose not

questions sanjay, i've been battling this ai, battle it every year and you could just look at my as medicine cabinet, but maybe you shouldn't. but let's jump right into these questions. mandy from atlanta wants to do what is the best over-the-counter option for treating allergies like this your thoughts on on fall allergies and what you can use to treat them? >> yeah. just a quick note, jim, as we talked about yesterday so this season is worse, so no surprise that you're having more symptoms perhaps than normal as are a lot of people. look, there's a lot of over-the-counter options nowadays to treat these medications, to treat allergies, histamine is what causes the symptoms so you're looking for something that isn't antihistamine kind of makes sense in the past, you had antihistamines would often be quite sedating things like benadryl. these medications now are much better at being non drowsy they don't cross the blood-brain barrier as well. a couple of quick points typically, he released the most

histamine between four and 6:00 in the morning. it's what helps wake you up that's why taking these medications the night before is probably a good idea and it can really take him, jim, throughout the season. i mean, when it comes to these medications, there's no problem taking them regularly there's some people who develop a lot of stuffiness, a lot of congestion and in that case there's the decongestant version of these as well. those are ones that you should really only take as needed they have different, different side effects, including interfering with your sleep they almost have like a caffeine, like side effects. so when it comes to decongest and sprays which are quite popular as well. they can be very effective, don't take them for more than three days in a row. again, it's because of these side effects, but lots of options out there. you just got to stay on top of it, not waiting for symptoms to appear and sanjay kim from indiana says that when she exercises outdoors during the fall should feel stuffy and congested even with an allergy pills, she wants to know how can i enjoy the outdoors while not

suffering for the rest of the day? >> i mean, that's a tough one because i mean, i get out there. i like to run yes. allergies be i'm going to do it anyway. but what can you tell her well, first of all, we haven't had a first frost in many parts of the country yet. >> so in a way, can stay hopeful here at once. you get that first frost. i think it's going to really cut down on these allergies for you as well. jim a couple a couple of points. one is that when it comes to exercising outdoors, really midday, early afternoon is going to be the worst time. so if you can avoid that time of day in particular, that's going to be helpful against stay on the medications throughout the allergy season. people take them sometimes just sporadically it can be well delayed then in terms of you actually getting relief from those medications once you're exercising. and finally, jim, something you may have noticed since you're a runner is that you probably start off with the most symptoms. but as you actually get into your run, the symptoms seemed to go down. that's because your body is starting to make epinephrine
